Moleskine MSK – Printing for your Moleskine Thursday, August 13th, 2009

Apologies for yet another post extolling the virtues of all things Moleskine, but my deep seated and long standing obsession with the little black books has been enhanced this week by the discovery of this neat little piece of software . Now you can custom print documents, online address books and page formats on your PC or Mac, and paste the directly into your Moleskine. Over the last few months I’ve been doing a free style version of this by cutting up pages of information that I need, and

Radical Solutions For Youth Unemployment Thursday, August 13th, 2009

The tragedy of one in six young people being unemployd is compounded by the inadequate official response. The knee jerk reaction from all agencies involved is to offer them some sort of training, in the hope that this will qualify them for whatever job they stumble across in the future. There is rarely any discussion about what training, and in any event the skills they will learn through conventional training are far less important than the skills they will fail to pick up by not being in work.

The Importance of Good Research Monday, August 10th, 2009

Reading the financial press this weekend left me somewhat confused. The sharp rise in share and commodity prices over the past month seems to have all commentators in agreement that the recession is entering a new phase. But they are split down the middle on whether we are at the beginning of an economic revival, or whether the recent rises are a ‘bear market rally’, meaning a temporary respite before another steep fall

Separating signal from noise, or re-reading a message with the expectation of different words Saturday, August 8th, 2009

Writing in the context of the discovery process in civil litigation, Anne Kershaw and Joseph Howie write in Law Technology News of the fallacy of reviewing identical copies of electronic messages as if each were, in effect, a separate paper document. In civil litigation, this increases delay and cost. In the context of intelligence analysis – particularly open-source – it’s a point ignored at the risk of missing important data – or reviewing it too late.

Mimosa Archiving Technology Puts Old E Mail At Your Fingertips Friday, August 7th, 2009

Legal Software As the number of e-mails, user documents and other content developed by businesses continues to explode, it’s important to have a technology that can archive that content and make it available, especially during legal discovery phases. Government regulations and transparency requirements, combined with the ever-present threat of lawsuits , raise the possibility that hundreds of thousands of documents might need to be searched and compiled for legal purposes. Mimosa Systems

Williams F1: where racing is oxygen Friday, August 7th, 2009

Brits on Pole’s Andy and LJH were invited by Williams F1 sponsor Philips to join other bloggers and web journalists for a tour of the team’s factory in Grove, Oxfordshire. The aim was to brief us on their competition to allow an ordinary fan to drive an F1 car but, while there, we also toured parts of the factory, interviewed technical director Sam Michael and visited the team museum. All in all we were there for half a day – here is what it’s like to be behind the scenes at an F1 factory

Text Messaging Client-Deponent During Deposition = Bad Idea Thursday, August 6th, 2009

I use instant message often during a deposition, in fact, often it’s invaluable.  But using IM (or any other means) to communicate with the deponent is a really bad idea (and a violation of the rules).  One lawyer found out the hard way, when a court ruled that the messages he exchanged with his client (the deponent) were subject to discovery by the opposing party.  D’oh.  Ngai v. Yet again, I’m extremely grateful to my fellow family historian and distant relative John Brechin, this time for making a fascinating discovery in the National Archives in Edinburgh. John has looked up the 18th century kirk session minutes for the parish of Auchterless, Aberdeenshire, and identified all the entries that appear to mention members of the Robb (or Rob) family.  He has kindly sent me both electronic and paper copies, and I’m indebted to him for his time and effort. Electronic Discovery and Legal Malpractice Thursday, August 6th, 2009

Electronic Discovery is with us, has been regulated, and there are now standards for its use in litigation.  Attorneys for clients now have to advise on how to store, produce, resist demands, and comply with the appropriate rules. Whenever there is general agreement upon a standard of practice, the question of deviation from that standard arises.  This is the central tenant of legal malpractice:  if there is a standard, attorneys must adhear.  Duane Morris reports on the Quallcom case: “Th
