So says Big Copyright , which adopted the term for copyright infringers because of “its suggestions of theft, destruction, and violence.” But now, the “pirates”have “co-opted the term, adopting it with gusto and hoisting the Jolly Roger across the Internet (The Pirate Bay being the most famous example).” I agree. Copyright infringers should not be called pirates.

Yesterday, CSO Insights released a summary of the results of their 16th annual Sales Performance Optimization study. The survey of 2,800 companies revealed that the number of reps making quota in 2009 dropped to 51.8% from 58.8% in 2008. This caused plan attainment to drop to 77.9% from 85.9%… And this is after 86% of the firms surveyed increased quotas for 2009

Gartner released a market overview specific to the insurance incentive compensation industry. For those who haven’t seen it or don’t have access to it, here is a summary of what I found to be the most interesting facts: There are 9 main ICM vendors in the life, property and casuality (P&C), and health insurance industry: ActekSoft, Callidus Software, CSC, CSSI, MajescoMastek, SAP, SunGard, Synygy and Versata

George Nemeth and myself have been invited to debate the silly notion that copyright laws should be changed to “protect” old media. Lordy lordy lordy. Dec. 1st, noon. Here’s a few of the issues I’ll bring up during the debate: – the 4th estate doesn’t get any more special treatment, they’re “just” a business like everyone else – Hollywood resisted the VCR when it first came out – and the DVD as well – 85% of Italians claimed they would NEVER use a cell phone – in 1989 – instead of trying to game the laws, why doesn’t the Plain Dealer think of itself as a platform?

15 November 2009 Reporting for The Posse List: Gregory Bufithis, Scott Madsen and Alex Hania Georgetown Law CLE, in cooperation with the Sedona Conference, presented its 6th Annual Advanced E-Discovery Institute . It was one of the best conferences we’ve attended on e-discovery and that is based on the content covered, the experts/luminaries in the e-discovery field that spoke at the panels, and the interaction between the audience and the panels plus the informal sessions. Moreover, the Institute had an all-star U.S. judicial bench in attendance: Judges John Facciola, Paul Grimm, Nan Nolan, Andrew Peck, Lee Rosenthal, Shira Scheindlin and David Waxe, who participated on multiple panels, and even sat in on many of the sessions and provided input — both from the panels and the audience — and who made themselves available during the breaks and informal sessions. It was a great “hands on learning” e-discovery experience. The non-judicial roster of e-discovery experts was just as impressive and rather than list them all we provide a link here.

The Eastern Ontario Economic Showcase on September 24th had several outstanding speakers including Donald Trump, Terry Matthews (our own Ottawa technology billionaire enthusiast, and Brett Wilson , another successful Canadian entrepreneur. George Paul says that digital record keeping has caused an evidentiary crises of societal proportions and that it is our responsibility, as lawyers, to find a resolution – to find a way of effectively testing the authenticity of digital records so they do “what people expect them to do,” and so that truth is found and justice done. The American Bar Association published Paul’s “Foundations of Digital Evidence ” in 2008
