The swine flu pandemic has spurred a flurry of litigation around the globe. Some experts predict that vaccinated and unvaccinated victims will target doctors and the medical industry for ills that befall as a result of the vaccine or lack of the vaccine, causing a surge of medical malpractice suits against doctors, hospitals, clinics, insurance companies and schools as the height of the flu season approaches. In fact, in preparation for the anticipated wave of swine flu litigation, the Department of Justice is hiring attorneys in its Office of Vaccine Litigation.

Move over Westlaw and LexisNexis, Bloomberg is scheduled to launch a new legal search engine at the end of the month, according to JD Journal . The new venture is a “legal, regulatory, and compliance research platform, offering a suite of news, data and analytics to the legal and compliance community.” According to its website, Bloomberg Law can be tailored specifically for the needs of modern professionals, providing indispensable resources for legal research, compliance, business development, sector intelligence, and other information needs. Those who want to preview the new database can register to view it on Bloomberg Law .

The UK’s Ministry of Justice confirmed yesterday that a new streamlined claims process has been agreed for road traffic accident (RTA) personal injury claims valued between £1000 and £10,000. According to the MoJ statement ( click here ): “The new process would provide for early notification of claims; promote early admissions of liability and early settlements; and remove duplication of work from the process.” The original manifestation of fixed fees for personal injury claims came into being on 6th October 2003. Let me digress for a moment and take the opportunity of explaining briefly how the fixed cost system works.

Managing Partner Mark Dawkins said “We’re not going to defend a business model that clients don’t want to have to pay for.” This time the company’s “three-year strategy” is to maximize efficiency. Opinion appears to be divided as to whether the unexpected dropping of H R Bhardwaj, from the post of India’s Law Minister, in Prime Minister Manmohan Singh’s new Cabinet, will have a detrimental impact on the pace of liberalization reform for India’s legal profession. In Legally India.com’s coverage , one Delhi lawyer, discussing the likely pace of change had Bhardwaj been invited into the new cabinet, commented: “If he had come in, we would probably be looking at a December opening.” The dichotomy of views was highlighted by Mulla & Mulla & Blunt & Caroe partner, Shardul Thacker: “This change will not in any manner hamper the legal liberalization of entry of foreign law firms.” According to Legally India.com , Bhardwaj’s replacement, Veerappa Moily is something of an unknown quantity. With the caveat that I am simply an interested observer, and a million miles away from being an expert on the issue, from a personal perspective, bar the recent passing of the Limited Liability Partnership (LLP) Act, little progress has been made over the course of the last decade.

The writer has used an excellent analogy to draw home the point that charging by hour is a sure way of driving your clients away from even the periphery of your office. One needs to understand the fact that payment of services should be based on the value addition done by the service provider rather than the number of hours the person has spent in courtship with the project
