Understanding foreign language document reviews Monday, July 27th, 2009

At this past April’s International Legal Support Leaders Conference (ILSLC) in Washington, DC, a seminar was devoted to the foreign language component of e-discovery and document review hosted by John Tredennick, an attorney and founder and CEO of Catalyst Repository Systems.  He expounded on the “how tos” of these reviews. As he pointed out, the common reference point is Unicode – the buzz word on the lips of every e-discovery provider and in seemingly every press release of every litigation software and service provider

Bubble Motion Secures Funds Monday, July 27th, 2009

Bubble Motion, which specialises in next-generation voice messaging, has secured $6 million (£3.65 million) in funding from new investor Palomar Ventures and existing investors Sequoia Capital and Comcast Interactive Capital. As part of the new investment, Al Snyder, CEO at Aepona, and Amanda Reed of Palomar Ventures, have joined the company’s Board of Directors. The company says that both announcements will support aggressive expansion of its product portfolio and its international subscriber footprint. “We have been fortunate to see phenomenal viral traffic growth with our portfolio of messaging services,” says Bubble Motion President and CEO, Tom Clayton. “And that traffic growth over the past year led to a tremendous amount of investor interest. We were very pleased to have this round be oversubscribed, with our existing investors fully participating. Even though we already had a strong balance sheet, we felt that it made sense to have some additional capital for strategic acquisitions and R&D investments to accelerate our growth.” Snyder brings 30 years of expertise in telecommunications and IT to the Bubble Motion Board. As CEO of Aepona, he has strengthened the company’s North American and European presence.

The Marking Up of Contract Lawyer Costs Saturday, July 25th, 2009

The practice of law firms marking up the cost of contract lawyers has been around for ages.  See some of our previous posts about the subject:  a great analysis by Carolyn Elefant by clicking here and further analysis by clicking here .  This week there was an article rocketing around the internet which was written by Cardozo Law Professor Lester Brickman and published in this week’s Forbes magazine.  We posted it on The Posse List Twitter account (we post items of interest to the Posse List community several times a day and you can see our feed in the right-hand column or click here ).   You can access the Brickman article by clicking here .   He summarizes the litigation process and then the use of contract attorneys in the e-discovery process and states: “As part of this process, each document is coded as to document type, author, recipients, date, subject and other bibliographical data and put into a searchable data base. The coding is largely done electronically by data processors or paralegals

When it comes to open sourced content management platforms and their creators, there’s no question about the celebrity status that WordPress and its young founder Matt Mullenweg have ascended to. If offered an opportunity to interview Mullenweg about some news, I’d undoubtedly jump on it. But when I was offered the chance to do the same with Dries Buytaert, my initial response was “Dries who?” Once I realized “Dries, the creator of Drupal,” I didn’t hesitate (podcast below).

MTRs Cost £1bn a year, says moneysupermarket.com Monday, July 20th, 2009

Following the launch by BT, 3 and moneysupermarket.com of the 'Terminate the Rate' campaign, which aims to bring down arbitrary mobile termination rates (MTRs), new moneysupermarket.com research reveals that MTRs cost consumers almost £1 billion a year (see footnote), yet 9 in 10 have never heard of them, even though they can account for as much as 80% of the cost per minute of a call from a home phone line to a mobile, or from a mobile to another mobile on a different network. When respondents were informed that MTRs are charged at 4.7p or more for each minute, despite the actual costs being less than a penny, 9 out of 10 people thought they represented an unfair hidden charge.

The European Posse List and Working in Europe Sunday, July 19th, 2009

There is an expanding need for temporary attorneys across Europe as many European companies and law firms have been adopting the use of temporary workers on a wider basis, as well as many U.S. companies and law firms which have applied the known U.S. model to their European operations.  Much of this is attributable to the use of blocking statutes and the impact of European privacy laws (for explanations click here ).   Most projects are more appropriate for attorneys based in Europe or U.S. attorneys that have a “home base” in one of the busier markets (see paragraph 10 below). These projects are often suitable for sole practioners based in Europe (many are special projects seeking EU law expertise) as well as  stagiaires who have done a stint with any of the EU institutions The first preference is always EU-based/EU admitted attorneys with multi-language ability

Sink or Swim Friday, July 17th, 2009

Ken Denman, CEO of Openwave, looks at what the industry can do to cope with the imminent tsunami of data as Smartphones and other mobile devices grow in popularity After years of talk about mobile data services, the day has finally arrived where demand is close to matching the hype. Instead of figuring out how to entice users to adopt new applications and services, the main issue at hand is how to deal with the imminent tidal waves of data usage heading to operators' networks.  In the last two years, we’ve seen Smartphones move to the mainstream, and we can expect continued uptake, along with the development of other mobile devices such as netbooks and PC dongles. According to Strategy Analytics, by 2011, the amount of mobile data traffic will increase nearly fourfold from its current levels.

The Rise of the Litigation Support Professional Friday, July 17th, 2009

There has been much discussion recently about the emerging litigation support profession.  The profession has evolved over the last 10 years right along with the growth of electronic discovery. Estimates indicate that there are over 10,000 litigation support professionals (LSP) in the U.S.   They operate at the intersection of law and technology, helping to steward ESI through processing, analysis, review and production. You will also find litigation support professionals increasingly involved in earlier phases of the e-discovery process, such as identification, preservation, collection and discovery conference preparation.  And many of these positions are held by Posse List members/contract attorneys who have moved full-time and part-time into the field.
