I don’t care what the news might say about how things are getting better.  And I don’t care if we’re on the upswing from this recession. The bottom line is, this is really, really hard. We all know business owners who have gone out of business.  We all know people who have lost their jobs.  We all know people who have been in a job search for over a year.  If there is a light at the end of the tunnel it sure seems really dim, or like a pinhole.

Doherty on Slaughterhouse, Libertarian Centralism, and the Fourteenth Amendment Wednesday, December 2nd, 2009

In Killing Slaughterhouse ( Reason Online ), Brian Doherty provides a superb, concise overview of the legal and libertarian issues regarding an upcoming Supreme Court, McDonald v. Chicago , about whether the Second Amendment should be “incorporated” into the Fourteenth Amendment so that it applies to the states, and related issues such as the Slaughterhouse Cases , “the controversial 1873 decision at the center of the Supreme Court’s upcoming gun rights fight.” The Slaughterhouse Cases in 1873 largely eviscerated the so-called Privileges or Immunities Clause of the 14th Amendment; decades later, the Supreme Court instead relied on the Due Process Clause of the 14th Amendment to “incorporate” some of the “fundamental” rights of the Bill of Rights to strike down state laws

Hayek, warned about the kinds of misguided economic policies that can lead a country down a road to serfdom of government control and domination over the citizenry. With the rapidly expanding power of government under the cover of the current economic crisis, I discuss in a new piece, “America’s Return to a Road to Serfdom?” the particular dangers our country faces in heading down a road the end of which leads to the loss of indiviudal liberty and the diversity of human choice that is a hallmark of a free society, and the strangling of free enterprise and the competitive pricing system through a growing spider’s web of government controls, regulations and restrictions

Realcomp Challenges FTC "Right" to Dictate Website Content Tuesday, December 1st, 2009

Last month , I noted the Federal Trade Commission’s order against Realcomp II, Ltd. The central idea is that the FTC claims the authority to dictate what content a private organization must publish on its website. (The FTC already has the power to dictate what content you can’t publish on a private website.) Under the Realcomp precedent the FTC could, hypothetically, force any public website to publish content that contradicts the website owner’s objectives or interests.

Jerry Pournelle on Copyright, Star Wars and Battlestar Galactica Tuesday, December 1st, 2009

On the latest This Week in Tech , guest panelist and sci-fi author Jerry Pournelle has an interesting anecdote about his involvement with a copyright squabble between Fox and Universal in the 1970s concerning Star Wars and Battlestar Galactica . As noted on Wikipedia: Battlestar Galactica was finally produced in the wake of the success of the 1977 film Star Wars . In fact, 20th Century Fox sued Universal Studios (the studio behind Battlestar Galactica ) for copyright infringement , claiming that it had stolen 34 distinct ideas from Star Wars

I spoke about the meaning and idea of individual liberty and the free society; the nature of and dangers from government; how government monetary and regulatory policies created the economic crisis we are in, and how current government policies are only making recovery more difficult; and I discussed the importance of free enterprise for a small nation such as the Bahamas.
