Beware False Patent Critics Wednesday, January 13th, 2010

This afternoon, FTC Chairman Jon Leibowitz holds a Capitol Hill press conference to “announce an FTC staff analysis showing that pay-for-delay deals between brand and generic drug companies are costing American consumers billions a year.” This refers to settlements of patent infringement cases where the patent holder pays a generic manufacturer to delay introduction of a competing drug.

Techdirt on why we don’t see widespread comparison/competition on doctor prices and services since “since publishing such info can run afoul of the copyrights.” apparently the various “codes” used by doctors to classify every visit are actually covered by a copyright held by the American Medical Association, which refuses to allow any free or open distribution of the codes (known as Current Procedural Terminology (CPT)). That’s because the AMA makes about $70 million per year “licensing” the codes. I’m having serious trouble figuring out what about the codes could actually be covered by copyright, however

Throughout law school, we were regaled from every angle with (hopefully) laudatory tales of career -ending, client-destroying, indiscretions, usually committed by some thoughtless junior associate in an elevator. … Also, I would caution against using “inept” in writing about large-firm lawyers , even in obscure, anonymous settings like this.
